MANILA, Philippines – Does Sarangani Representative and boxing champion Manny “Pacman” Pacquiao have a green card from the United States?

This is the question posted by blogger Raissa Robles in a lengthy post on Monday, noting the political ramifications should it be proven that Pacquiao holds a U.S. green card.

Robles cited the website of Wilner & O’Reilley, a California law firm that specializes in immigration. A March 2005 post showed that Pacquiao – then just beginning to take his first steps towards boxing superstardom – had hired the firm as his “immigration counsel.”

Another post on the website, dated 2009, called Pacquiao a “successful immigrant.”

A U.S. immigrant – or a holder of a green card – is not an American citizen, Robles noted. However, green card holders are banned from running for office in the Philippines, according to the Omnibus Election Code.

Robles said if Pacquiao acquired a green card in 2009, that should have disqualified him from running for office in the 2010 elections, and for re-election earlier this year, “unless he had first waived his permanent residency or immigrant status to the U.S.”

Whether or not he has a green card will also have bearing on Pacquiao’s on-going tax case. The Bureau of Internal Revenue has said that the boxer still has over P2-billion unpaid taxes. Pacquiao said he paid his 2008 and 2009 taxes in the U.S.

“Manny Pacquiao has long denied he is a green card holder,” Robles wrote, noting that in a television interview, the boxer showed his U.S. tax returns for 2008 and 2009. “He pointed out that the documents showed he was a ‘non-resident alien,’ which implied he did not have a green card.”

But Robles also said Pacquiao only showed Page 1 of his 2008 and 2009 tax returns on TV. The interesting details, she said, could be found on Page 5, wherein Pacquiao was “required to disclose if he was ever a green card holder or if he every applied for one; what his visa type was on the last day of the tax year; and if he has every changed his visa type.”

According to Section 68 of the Omnibus Election Code: “Any person who is a permanent resident of or an immigrant to a foreign country shall not be qualified to run for any elective office… unless said person has waived his status as a permanent resident or immigrant of a foreign country in accordance with the residence requirement provided for in the election laws.”

Benefits of Green Card
Green Card is a commonly used name for Permanent Resident Card, previously known as Resident Alien Card.

Even though there are many benefits of having a green card, there are many restrictions and obligations as well. Make sure to read retain green card[2] to completely understand them.
Ability to leave/enter the U.S. at will without the risk of being denied entry by an Immigration Official at the port of entry. Some jobs require security clearance that only green card holders and U.S. citizens can get. Therefore, a green card provides more job opportunities.

Permission to start own business and create own corporation.

Green card holders get Social Security benefits when they retire, if they worked for 10 years (40 quarters to be precise) before retiring.

Green card holders can sponsor spouse and unmarried minor children under 21 to obtain permanent status.

If you obtained green card for your family, they will retain it even if you pass away or lose your job.

With work permit, primary visa holder's spouse and minor unmarried children under 21 are allowed to stay in the U.S. as dependents. If you are in the U.S. on a work permit, your children will have to get student visas to study and work visas to work.
However, once they get a green card, they can stay in the U.S. even after turning 21 and even if they get married.

Immunity against future changes in immigration rules that could hurt your temporary permit.

Access to security clearances, eligibility for government grants and exemption from export restrictions.

Most legal rights under U.S. law, except for the right to vote which is available only to U.S. citizens.

Eligibility to apply for U.S. citizenship later. You don't have to take U.S. citizenship and you can be a green card holder forever. If the country of person's current nationality allows dual citizenship, a person can get U.S. citizenship without giving up current nationality.

It may be easier to get a mortgage for home purchase. Many banks require green card or other long-term visa before granting a mortgage. Some banks may charge higher rates for non green card holders for a mortgage.

Some states require that you have a green card before granting you professional licenses such as real estate agent, insurance agent etc.

Many insurance companies require that the person have green card before giving health or life insurance.

Green card holders can permanently stay in the U.S. anywhere in the 50 states of United States.

Green card holders can make political campaign contributions in connection with state and federal elections. Other foreign nationals can't.

Even though not applicable to most people, there may be a possible tax benefit to green card holder who may be taxed as "non-resident" in home country.

You can legally own property, cars, firearms and other items that any other average American does.

i saw the news minutes ago and manny denied this issue

here's what he said..

MANILA - Sarangani Rep. Manny Pacquiao on Tuesday denied he had a green card or a permanent resident status in the United States.

Pacquiao showed up in Congress for the first time since he won his last fight in Macau several weeks ago.

Interviewed by reporters, Pacquiao said he did not even allow his children to study in the US despite their wishes.

"Ayaw ko nga pag-aralin ang mga anak ko sa Amerika. Mga anak ko gusto mag-aral sa Amerika," he said.

He confirmed that what he has is a P1 visa that allows him to work and earn income in the US.

"Wala naman akong green card. May P1, Oo para puwede ka lumaban, kumita doon," he said.

He said he is leaving up to God those who insinuate he is a green card holder.

Pacquiao also denied he has plans of joining the House minority, despite the Bureau of Internal Revenue's garnishment of his banl accounts over tax issues.

His lawyer, Tranquil Salvador, earlier denied in a text message that his client is a green card holder.

Pacquiao showed up at the House of Representatives to receive a resolution of commendation from his colleagues on his recent victory.

"Masaya ako dahil binigyan nila ako ng parangal sa House. Salamat sa suporta ng mga kasamahan ko," he said.

Pacquiao is the richest lawmaker in the last Congress. He is also its top absentee, based on the House journals.

yes yan po reaction nya. ang gusto po natin malaman kung anung uri syang tax payer dun sa income tax nya sa IRS. kasi may balita na nakalagay dun na sya ang nabigyan ng tax privilege na binibigay lang sa isang green card holder. hmmmmm parang isa ito sa rason kung bakit ayaw nyang mag submit ng mga documents galing sa IRS sa BIR.  Un ang missing link. heheheh kuro kuro lang po ito.
