Good day mga ka PT sino po dito ang may alam sa legal na batas? Magtatanong lang sana ako kung ano ang pwedeng isampang kaso sa babaeng kabit pero dalaga sya at yung lalaki lang ang may asawa? Pwede ba sampahan ng kasong adultery ung babae or concubinage lang ang pwedeng ireklamo sa kanya?

thank you miss sieraswind...pero ung pwedeng ikaso sa babae at ang magkakaso eh!ung legal na asawa nung lalaki yun ung gusto kong malaman.

sa pagkakaalam ko, pedeng sampahan ng kasong concubinage yung lalake at yung babe, pero hindi pedeng yung kabit na babae lang ang kakasuhan. dapat yung lalake at babae ang kakasuhan, kung buhay pa sila pareho.

better if you ask for advise from a lawyer... may PAO naman... try to ask assistance first to make sure that whatever step you'll take is correct and legal...

Hi Chinggay, not adultery or concubinage but you may file a civil case for damages against the mistress or lover alone, thru Article 26 of the civil code, that includes damaged for a third party in meddling or disturbing a private person's life.

Just to clear things, adultery cannot be filed on husband since it can only be filed with the wife and her lover.
On the otherhand concubinage is commited by a husband by having scandalous sixual intercourse and the likes. Or having proven of keeping a mistress in conjugal dwelling.
concubinage is difficult to prove in court and better to seek RA9262 orAnti-Violen ce Against Women and Their Children Act. File a case of psychological violence due to marital infidelity.
The maximum penalty is imposed if the violence is committed by the husband or the intimate partner against the woman when she is pregnant or in the presence of their children.

RA 9262 ang pwede i-file sa husband...concubinage if it falls under the three instances mentioned in previous post...RA 9262 has a higher penalty than that of concubinage.
