Title: about buying lot

balak kong bumili ng lot. ok na usapan namin mag kakanotaryo na lng kami (walang title kasi bigay ng nha).
may balak sana sa brgy pirmahan kaso naghihingi 5% kaya idadaan na lng sa notaryo at di idaan sa brgy

eto mga senaryo naiisip ko:
1.) habulin kaya ng mga anak(usapang mana)
2.) puwedeng bawiin ang lot kasi alang title?

better double check on that ts... even if it was given by nha, there should be some documents pertaining to the ownership of the lot... regarding your questions, it can only be answered if you find the documents i am telling you... think twice ts...

update ko may certification ala title pero may rights. so correct me if im wrong kung may rights ako parang may title rin ako tama?

ang pagkakaalam ko kung rights lang hindi pa sayo ang property, kasulatan lang yan na pwede mong gamitin na balang araw pwedeng bawiin sayo o pabayaran.  Pag may Title, sigurado sayo yan.

kung bigay yan ng NHA, dapat may award na kasama yan. patunay na sa iyo ina award ng NHA ang lupa.

hindi malinaw kung paano yung tungkol sa pagbawi ng mana, kanino ba galing ang lupa...


i think originally inaward yan ng NHA sa 1st owner, ngayon doon ninyo bibilhin ang lupa. tiggnan ninyo ang award, normally may restriction yan na hindi puedeng ibenta for some period of time from the date of award , normally mga 5 years ang restriction, kung lagpas na ang restriction at  nakapangalan naman  sa  nag benta sa inyo ang award , hindi na mahahabol yan....

if you can scan and upload even the contents only of the certification you said then everything will be clear... the reason i am asking you this ts is because i have a cousin in nha which we can ask regarding the real status of the lot.. yes, it is also right that the nha gives an award certification to the recipient of the lot.. and it is also true that once awarded, you cannot sell the said lot for a certain period of time, which i think is 10 years... and lastly, a right is not the same as a lot title... if it is only a right, then the agency involved may claim back the lot if needed...

hmmm... tama si sir naruto, what was being shown or given to you is only a property right... therefor, common sense dictates it's not a title... rights can be revoked at any given period of time depending on what was stipulated on the rights itself.... hmmm... if my memory serves me right, these cases pertaining to NHA awarding of rights are commonly given to informal settlers of which the latter often received and sell it to others and they are called 'professionals' when it comes to this... i hope these so called professionals are not one of those selling to you... it pays to consult a legal adviser, think of it as a loose change when hiring one rather than not consulting one... mahirap ito syempre hard earned money ang ipambabayad mo diyan... di na bale na maghintay sila sa perang bibitawan mo kesa naman sa nagmamadali ka magkabilihan.... please heed the reply of sir naruto... maging wise tayo sa pagbili, wag padaskol daskol o impulsive.... you must not create something that will haunt you later on....

i think it is still called a "deed of absolute sale"... however, in cases of awarded lots by the nha, it should be first verified and noted by the agency prior to the sale... in short, you still have to coordinate with the nha before making any payments to the seller...

Inquire with NHA about the said lot so that you can be informed properly, otherwise, posibleng ma 1-2-3 ka diyan ng babayaran mo. NHA properties are government properties,hence, hindi siya basta basta maibebenta lang, pag ibenta man, thru bidding pa. Kung rights lang ang ina assign sayo, dapat nakalagay din dun kung good for ilang years yung right na yun at kung ano lang ang pwede mong gawin sa property na yun for that period of time.

I think the right to possession and occupation lang siguro ang binebenta nya sayo TS. Inquire ka na NHA kung ang seller ba talaga ang registed applicant nito.
