Hingi lang po sana kami ng advise.May nabili po kami na house and lot sa isang subdivision(rent to own thru pagibig)dahil sa nagkaproblema kami magasawa,hindi na naituloy ang paghulog sa bahay.ang problema po namen ngayon,pinarentahan po namen ang bahay,at ayaw na umalis ng nagrereny,dahil sa hindi na daw kami nagbabayad ng bahay.ano po ba dapat namen gawin?salamat po sa mga sasagot

you are still the legitimate owner of the house notwithstanding your failure to pay the monthly amortization... unless pagibig had foreclosed your unit already, you are still the legal owner... hope this helps ts...

Sir Naruto,ano po yung step or action na pwede namen gawin para mapaalis po yung nagrerent.ang reason kasi po kasi nung nagrerent,pagibig na lang daw yung may karapatan magpaalis sa kanila.salamat po sir

first of all pagibig doesn't recognize them... best way to do is to go to pagibig and talk with them regarding your interest in resuming payments on your mortgage... once you are able to reconcile with pagibig, go to the barangay and ask their help to evict the tenants... lastly, don't commit the same mistake again, it is part of pagibig's ruling that you cannot rent out your unit unless it is already paid in full...

Naruto is right, technically, you are still the owner of the property even if it is mortgaged to pagibig.
You can file an action for ejectment. specifically, unlawful detainer.

If within 1 year pa from the demand to vacate file an unlawful detainer.
