Title: Subdiving a property from one single title

Good day po mga ka-pt,
I have a property with a single title. Now I want to subdivide it into 3 lot so that it can be sold separately.

1) What is the procedure in separating a lot?

2) Should the separated lot have their own title each under my name?

3). In case 3 titles have to be created, do I need to pay for any transfer tax, capital gain... etc?

4). Can I not just sell (deed of sale) first then create a title (TCT) under the name of the buyer for every lot sold?

Help naman po. I am not very much aware of the legal procedures.

1)Dapat po mag attach po kayo ng plan fordivision of the lot. eto po yung panu gusto nyo idivide yung lot. Iattach po nyo dun sa main title po ng lot then submit po nyo sa LRO na may sakop nung lugar kung saan yung lot. kung usapin po ng kung mag kanu ang babayaran yun po ay diko na alam.

2)opo. ang makikita po nyo sa taas ng titulo ay TCT #-A,TCT"-B and so on. depende po kung ganu karami yung pag kadivide.

3) yes po. kasi magkakaibang lot na po yun once na divide.

4) ang pag kakaunawa ko po sa tanung nyo ay yung original lot gusto nyo ibenta yung portion lang po nya? hmmmmm hindi po pwede kailangan po hatiin pa po nyo muna bago nyo ibenta.
ang prinsipyo po sa batas ay "indivisibility of title".

Kung may proseso man akong hindi nabanggit ay lubos po akong nag babaang loob sa mga taong lubos na nakakaalam.

Kung ang lote at nasa loob ng subdivision, I-check ninyo kung may restriction sa pag-subdivide.

Ibig ko pong sabihin, mayroong mga communities or subdivision na May annotation sa title whether papayagan or hindi na ma-divide into smaller portions ang property.

Sa subdivision kung saan po kami nakatira, pwede mo lamang I-subdivide ang isang lote na consolidated from several properties into a single title. For example, dalawang lote na-consolidate into one title, later on pwede mo ulit pa-subdivide into a maximum of two titles/properties, like it was originally.

Kung wala naman pong restriction or annotation ang title ng property nyo, pwede kayong magpa-titulo ng bago, from one title to 3 separate titles.
