Professing one's love or affection towards another person kahit parehas pa kayong married is never a crime,unless you do overt acts or put it into action such as having sixual intercourse under scandalous circumstances (this is difficult to prove) or leaving your family family for that person.
There are two (2) forms of "criminal infidelity", Adultery and Concubinage. Adultery is more commonly associated with married women while concubinage is commonly associated with married men.
Note that the sixual intercourse of the man must be UNDER SCANDALOUS CIRCUMSTANCES to be guilty of concubinage, while any intercourse of the woman will qualify for adultery. The SC defined SCANDALOUS CIRCUMSTANCES as "any reprehensible word or deed that offends public conscience, redounds to the detriment of the feelings of honest persons and gives occasion to the neighbors' spiritual damage or ruin.
The Supreme Court have some rulings on this,
1) the people in the vicinity where the acts were commited are the best witnesses to prove scandalous circumstances , hiring private investigators or spies cannot be considered as evidence
2) There is no concubinage if the married man is surprised in the act of sixual intercourse with a woman not his wife in a hotel.
3) A person who keeps his mistress in an apartment furnished by him is not guilty of concubinage if he does not live or sleep with her in said apartment.
Medyo lumalim na,ibang topic na yata ito pero this is in anticipation lang of your next question.

Minsan dito nga pumapasok ang word na *unfair* kagaya sa case ni Jan_ice03 na medyo malalim na ata ang epekto ng pakikipagchat...but unfortunately wala po kayo magagawa just to wait and gather all the evidence you can have.. its really sad minsan na maraming nasisirang pamilya dahil sa chatting or sa third party but as I said earlier at iniexplain ni sir Habagat na walang kaso hanggat nasa net lang kayo... siguro mam or sir bigyan nyo na alng ultimatum si mister /misis papiliin nyo lalo na kung ang mga bata ang apekltado....

Tanong ko lang TS, to what extent ang pakikipagrelasyon mo sa internet? Ano ang ginagawa nyo? in general professing love to anyone is never a crime unless accompanied by illegal overt acts. You should take note of these overt acts, acts that constitute concubinage, adultery and violation of R.A 7610.

I agree with you sir hirap kase haluan ng spiritual ang legal matter but I can not blame as well our fellow ka PT na nag bibigay ng spiritual advice perhaps this is their way to join to our conversation at concern din sila... perhaps it will be our duty na lang to elaborate and try to seperate the two different point of view.... kase sa totoo lang iba talaga ang spiritual point of view compare to Legal Matter....

opo. sa batas hindi crimen ang state of mind, halimbawa kahit ilang beses ko pinatay ang kapitbahay ko sa utak ko, hindi ako pwede panagutin nito. External acts lang po pwede regulate ng batas.

sir, base on my research....pangangalunya is adultery kapag babae ang nagkasala at concubinage kapag lalaki ang parusa dito is kulong and ground for annulment ang kasal....but on the case if this is on the internet hindi ito dito classified kasi ang pangangalunya needs physical intimate contact....siguro not sure kasi hindi naman ako lawyer, pero pwede itong magfall sa Civil Code of the Philippines

yung fidelity kasi eh malawak para sa akin which means cheating and of course mutual respect....and base on this code...sa article 116:Article 116. When one of the spouses neglects his or her duties to the conjugal union or brings danger, dishonor or material injury upon the other, the injured party may apply to the court for relief.
The court may counsel the offender to comply with his or her duties, and take such measures as may be proper. (n)

Yes tama ka dyan. ang magiging kaso mo kung sakali ay legal separation gamit yung grounds na hindi ginagamapanan ang marital obligation or pwede ring sixual infedelity. Nasa sayo kung panu ka makakakuha n ebidensya para support yung mga grounds mo. Sa akin lang ang kaya lang ng court na i counsel yung offender diba pero hindi nya pwede piliting pabalikin sa conjugal dwelling or piliting gawin mga responsibility nya bilang asawa.
sa punto mo na mag cause ng mental trauma, hmmmm ang solution dyan file ng legal separation case ground mo? yung RA 9262. diko lang kabisado kung anung art yun.

may mga prerequisites naman para makasuhan ka ng concubinage:
- scandalous activity: kahit magkasama pa kayo sa mall ng kabit, pero hindi naman scandalous yung ginagawa nyo, i.e. dating, eating, etc. madali kasing ilusot yun, tipong business activity; if dinala mo naman sa Motel ang kabit at nagsix kayo, at may nakakakita sa inyo papasok ng hotel, hindi rin yun scandalous, kasi sa room naman kayo titira eh.
- living with the woman not your wife: wag ibahay ang kabit, o kung bibilhan mo man ng bahay ang kabit, eh wag mo ipangalan sa iyo ang bahay; dapat din wag ka mag iwan ng gamit mo sa bahay ng babae para hindi masabing nakatira ka dun.
....walang lalakeng umaamin..

sir, yung scandalous activity po na nasa batas ibig sabihin po nun ang presentation nila sa public ay parang mag asawa. ang example po nito ay kuha sa isang kaso na yung magkalaguyo ay nag papiocture sila tapos na print pa sa newspaper.
Sir may malaki po pag kakaiba sa adultery at concubinage. Yung grounds po kasi ng adultery mas madali patunayan kaysa sa grounds ng concubinage. at sa concubinage po isang count lang, samantala yung adultery ay every carnal knowledge. sinasabi ko po ang pagkakaibang ito sapagkat mag kaiba yung nature ng babae at lalake.
